Terms of Service

1. Agreement

By using FairSign ("the Service"), you agree to these Terms of Service. FairSign is operated by The Fair Company ("Fair", "we", "us"). If you do not agree to these terms, do not use the Service.

2. The Service

FairSign provides electronic signature services. You can upload documents, add signature fields, send them to recipients for signing, and download completed documents with full audit trails. All electronic signatures created through FairSign are legally binding under the ESIGN Act, UETA, and applicable international laws.

3. Account

You need a Fair account to use FairSign. One account gives you access to all Fair products. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account.

4. Payment

FairSign uses a prepaid, pay-per-use model. There is no subscription. There is no auto-renewal. There are no annual contracts.

  • You top up your Fair wallet with any amount ($5 minimum).
  • Each signature collected costs $0.05 (or the current published rate).
  • Wallet balance never expires.
  • If you don't use FairSign for a month, you pay $0. There is nothing to cancel.
  • Current pricing is always published at fairsign.ai/pricing.

5. Your Content

You retain all rights to documents you upload. We do not claim ownership of your content. We do not use your documents for training, marketing, or any purpose other than providing the signing service.

6. Data Handling

Documents are encrypted at rest (AES-256) and in transit (TLS 1.3). Signed documents are stored for 7 years unless you request deletion. See our Privacy Policy for full details on data handling.

7. Acceptable Use

You may not use FairSign to:

  • Send fraudulent or deceptive documents
  • Forge or misrepresent signatures
  • Violate any applicable law or regulation
  • Interfere with or disrupt the Service
  • Attempt to access other users' accounts or documents

8. Limitation of Liability

FairSign is provided "as is." We make commercially reasonable efforts to ensure uptime, security, and legal compliance. Our total liability is limited to the amount you've paid for the Service in the 12 months preceding any claim.

9. Dispute Resolution

Any disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, in the jurisdiction where The Fair Company is incorporated. You waive any right to participate in a class action.

10. Changes

We may update these terms. Material changes will be communicated via email to the address on your account at least 30 days before they take effect. Continued use after changes constitutes acceptance.
